1.2.HelpStreetCat or Platform means the aggregate of digital, software, technical, and organizational solutions owned by the Company or lawfully used by it, including the Application, the Website, software, user interfaces, server infrastructure, Digital Services, and the related Infrastructure.

1.3.Application means the HelpStreetCat mobile application, including its current and future versions, updates, software components, and functionality.

1.4.Website means the Company's official website located at https://helpstreetcat.com, as well as any other internet domains, subdomains, localized versions of the website, and web interfaces owned by the Company or lawfully used by it for the operation of the Platform, the provision of Digital Services, and the publication of documents, information, and other HelpStreetCat functionality.

1.5.User means an individual who accesses or uses the Platform, in whole or in part, regardless of whether they have an Account or purchase paid Digital Services.

1.6.Account means the User's personal digital record within the Platform, created for the purpose of identifying the User, storing data associated with the User, and providing access to certain functions and Digital Services.

1.7.Digital Service means a separate functionality, digital service, or combination of functions made available to the User through the Platform on a free or paid basis, including functions whose performance involves the automated interaction of the Platform software with the Company's Infrastructure.

1.8.Paid Digital Service means a Digital Service to which access is granted after the User completes the payment required by the Platform, acquires the corresponding right of access, or uses the required amount of CatPayCoin, Feedings, or other Internal Digital Objects.

1.9.Transaction means an action recorded in the Platform's information systems, either directly confirmed by the User or automatically executed on the basis of and within the scope of an action previously confirmed by the User, including, without limitation, the acquisition, crediting, use, deduction, Transfer, refund, restoration, cancellation, or other processing of CatPayCoin, Feedings, Subscriptions, Bonuses, and other Internal Digital Objects, or the receipt and use of a Digital Service.

The automatic execution of technical or accounting actions within the scope of a Transaction previously confirmed by the User shall not constitute a separate paid Transaction and shall not create an obligation for additional payment unless the User has separately confirmed such payment by a method provided by the Platform.

1.10.CatPayCoin Balance means the information displayed in the Account regarding the amount of CatPayCoin available to the User. The CatPayCoin Balance is an element of the Platform's internal accounting and does not constitute a bank account, electronic wallet, monetary deposit, payment account, or means of storing funds.

1.11.CatPayCoin means the Platform's internal digital unit used exclusively within the functionality of HelpStreetCat. The designation "CatPayCoin" is also a registered trademark of the Company.

CatPayCoin is not legal tender, electronic currency, electronic money, cryptocurrency, central bank digital currency, a security, an investment asset, a payment instrument, a banking product, or any other independent financial instrument.

The possession of CatPayCoin does not entitle the User to demand its exchange for money, payment of its nominal, purchase, or any other value, or its redemption by the Company, except where expressly required by mandatory provisions of applicable law, the rules of the relevant Payment Provider, or this Agreement.

1.12.Feeding means the right recorded in the User's Account to initiate, on a one-time basis through the Platform, the dispensing of the portion of pet food specified by the Platform using one of the available feeders within the Infrastructure.

A Feeding may be purchased with CatPayCoin, provided as part of a Subscription, credited as a Bonus, transferred by another User where such functionality is available, or obtained by any other method provided by the Platform.

A Feeding is an internal digital right to use a specific Platform function, is not legal tender or an independent financial asset, and does not entitle the User to demand its exchange for CatPayCoin or money, except where expressly required by mandatory provisions of applicable law or this Agreement.

A Feeding grants the right to use the relevant Platform function and to send a command to dispense a portion of pet food but does not, by itself, guarantee the presence of an animal near the feeder, the consumption of the food by a particular animal, or the occurrence of any other result dependent on the behavior of animals, environmental conditions, or third parties.

1.13.Infrastructure means the feeders, cameras, communication devices, servers, hardware and software systems, power supply sources, and other technical equipment owned by the Company or lawfully used by it to ensure the operation of the Platform and the provision of Digital Services.

1.14.Feeding Initiation means the User's transmission, through the Platform, of a digital command to use one available Feeding and dispense the portion of pet food specified by the Platform through the feeder selected by the User or automatically designated by the Platform.

Execution of the relevant command is carried out automatically, taking into account the technical condition of the Infrastructure, the availability of the feeder, the applicable algorithms, established limitations, and other technological parameters of HelpStreetCat.

Feeding Initiation means the Platform's acceptance of the relevant digital command for execution and shall not be construed as a promise by the Company to ensure the presence of a particular animal, the consumption of the food by such animal, or the continuous ability to visually observe the feeding process, unless such result is expressly guaranteed under the terms of the relevant Digital Service.

1.15.Subscription means a Digital Service provided for a specified period or for recurring billing periods which, in accordance with the terms of the relevant offer, may provide the User with access to certain Platform functions, periodic or one-time crediting of Feedings, the provision of Bonuses, special terms, benefits, or other HelpStreetCat features.

The composition of the Subscription, the duration of the billing period, the subscription term, the price, the payment procedure, the availability and procedure for automatic renewal, the methods of disabling such renewal, the consequences of terminating the Subscription, and other material terms shall be displayed to the User before its purchase.

Automatic renewal of a Subscription shall apply only if such possibility was clearly disclosed before its purchase and separately confirmed by the User through a method provided by the Platform.

1.16.Bonus means a Feeding, CatPayCoin, Subscription, temporary or permanent access to a Platform function, digital skill, achievement, digital item, special feature, benefit, or other Internal Digital Object provided to the User without separate payment as part of a Game Mechanic, loyalty program, promotional campaign, Subscription, special offer, compensation, or on any other basis provided by the Platform.

Unless expressly provided otherwise by the terms of the relevant Bonus, a Bonus has no independent monetary value, is not exchangeable for money, cannot be withdrawn from the Platform, sold, or repurchased by the Company, and may be used exclusively within the HelpStreetCat functionality.

1.17.Internal Digital Object means a digital unit, right, status, function, item, skill, achievement, benefit, Bonus, or other intangible element of the Platform's internal digital economy that is recorded or displayed in the Account, including CatPayCoin, Feedings, and Subscriptions.

Internal Digital Objects exist exclusively within the Platform, are used in accordance with their functional purpose, and grant the User only those contractual rights to use the corresponding HelpStreetCat functionality that are expressly provided for by this Agreement, the terms of the relevant offer, and the Platform interface. They are not legal tender or independent financial assets unless otherwise expressly required by mandatory provisions of applicable law.

1.18.Additional Platform Functionality means additional methods of User interaction with Digital Services provided by HelpStreetCat, which may include Game Mechanics, Automatic Feeder Selection, additional user scenarios, interactive interface elements, digital objects, achievements, special features, entertainment elements, and other auxiliary functions intended to improve the usability of the Platform, diversify the user experience, and increase User engagement with HelpStreetCat Digital Services.

Additional Platform Functionality forms part of the overall HelpStreetCat functionality and does not, by itself, alter the Platform's primary purpose of providing digital services for the remote feeding of animals.

1.19.Game Mechanic means an element of the Additional Platform Functionality that provides for interactive User engagement with HelpStreetCat Digital Services through specific actions, user scenarios, visual and entertainment elements, achievements, digital objects, special features, automatic determination of certain parameters, or other methods of interaction provided by the Platform.

Game Mechanics are intended to increase User engagement, diversify the user experience, and expand the functional capabilities of the Platform. The use of a Game Mechanic does not, by itself, constitute participation in gambling, a lottery, betting, investment activities, or any other activity aimed at obtaining monetary or other proprietary gain outside the Platform.

1.20.Automatic Feeder Selection means a Platform feature under which one of the available feeders is selected automatically without requiring the User to make an independent selection.

Automatic Feeder Selection is used to determine the device through which Feeding Initiation will be carried out and may be accompanied by Game Mechanics, animations, interactive elements, visual effects, or other elements of the Additional Platform Functionality.

The use of Automatic Feeder Selection does not alter the content, scope, price, or primary purpose of the relevant Digital Service.

1.21.Transfer means the movement of CatPayCoin, Feedings, Subscriptions, Bonuses, or other Internal Digital Objects from one Account to another through the functionality provided by the Platform without exchanging them for money.

1.22.Company Content means texts, images, video recordings, live broadcasts, audio materials, graphic elements, interfaces, databases, software code, documentation, and other materials owned by the Company or lawfully used by it, regardless of the method of their creation, storage, or display, that are placed within the Platform or used in its operation.

1.23.Observation Materials means images, photographs, video recordings, video stream fragments, and other visual materials available through the Platform that are obtained using the Infrastructure cameras, including materials that the User is entitled to save to the User's device where such functionality is provided by the Platform.

1.24.Company's Intellectual Property Objects means trademarks, trade names, logos, software, source code, object code, databases, designs, industrial designs, inventions, utility models, patents, patent applications, technical solutions, technologies, documentation, works, know-how, trade secrets, and other protected results of intellectual activity and means of individualization owned by the Company or lawfully used by it.

1.25.Privacy Policy means a separate HelpStreetCat document governing the processing, storage, protection, and deletion of Users' personal data.

1.26.Agreement means this HelpStreetCat User Agreement, including all current amendments, supplements, and documents expressly incorporated into it by reference.

1.27.Applicable Law means the laws of the Republic of Türkiye, as well as the mandatory provisions of the laws of any other jurisdiction applicable to a particular User, Transaction, or legal relationship irrespective of the parties' choice of governing law.

1.28.Unless the context of this Agreement expressly requires otherwise, words in the singular include the plural, and words in the plural include the singular.

1.29.Feeding Balance means the information displayed in the Account regarding the number of Feedings available to the User.

The Feeding Balance is an element of the Platform's internal digital accounting, is not a bank account, payment account, electronic wallet, or means of storing funds, and does not confirm that the User has any ownership rights to pet food, a feeder, or any other property of the Company.

1.30.Payment Provider means a bank, payment institution, payment system operator, mobile application store, payment technology provider, or other third party through which the acceptance, processing, confirmation, refund, or other support of monetary payments related to the use of the Platform is carried out.

Where the Payment Provider provides services directly to the User under its own terms and conditions, the relevant relationship between the User and the Payment Provider shall also be governed by the terms and conditions of that Payment Provider and the laws applicable to it.

2. Acceptance of the Agreement and Account

2.1.This Agreement becomes effective for the User from the moment the User performs any one of the following actions:

  • creating an Account;
  • confirming acceptance of the Agreement through the Platform interface;
  • beginning to use any Platform function available without registration;
  • performing any other action that, in accordance with the Platform interface, unequivocally indicates acceptance of this Agreement.

2.2.By accepting this Agreement, the User confirms that he or she:

  • has reviewed its contents before beginning to use the Platform;
  • understands the meaning and legal consequences of its terms;
  • accepts the Agreement in full and without reservations;
  • provides accurate information about himself or herself;
  • possesses the legal capacity and authority necessary to accept this Agreement.

Acceptance of this Agreement does not constitute a waiver by the User of any rights or guarantees that cannot be limited or excluded by agreement of the parties under the mandatory provisions of Applicable Law.

2.3.Mere review of publicly available informational materials on the Website, without creating an Account, using Digital Services, or performing any other legally significant actions, shall not constitute the conclusion of a paid Transaction.

2.4.Each paid Transaction shall be concluded separately after the Platform displays to the User the information provided by the Platform regarding the Digital Service being acquired, its price, the procedure for its provision, and other material terms.

2.5.Before completing a paid Transaction, the User must perform the action provided for by the Platform interface that unequivocally confirms the User's intention to acquire the relevant Digital Service and accept the corresponding obligation to make payment.

2.6.Information regarding a confirmed Transaction may be provided to the User through the Platform interface, the transaction history, by email, electronic receipt, application store notification, payment operator notification, or by any other method that allows the relevant information to be stored and reproduced.

2.7.A User who has reached eighteen (18) years of age or any other age of full legal capacity established by Applicable Law may independently accept this Agreement, create an Account, and enter into paid Transactions.

2.8.A person who has not reached the age of full legal capacity may use the Platform only to the extent permitted by Applicable Law, with the prior permission and under the supervision of his or her legal representative where such permission is required.

2.9.Paid Transactions performed by a minor are permitted only with the necessary consent of the minor's legal representative and by using a payment method lawfully available to such person. By providing a minor with access to a payment method or the ability to perform a paid Transaction, the legal representative confirms authorization for such use to the extent permitted by Applicable Law.

2.10.The Company may establish a minimum age requirement for creating an Account, accessing individual functions, Digital Services, and payment methods, may request reasonable proof of age or of a legal representative's authority, may restrict a minor's access to certain functions, and may refuse to process a Transaction where there are reasonable grounds to doubt the existence of the required authorization or the lawfulness of the use of the relevant payment method.

2.11.If the Company receives reasonable information indicating that a minor's Account has been created or is being used without the necessary authorization of the minor's legal representative or in violation of the applicable age requirement, the Company may temporarily restrict such Account, request additional information, terminate access to certain functions, or delete the Account in compliance with Applicable Law and the rights associated with previously confirmed paid Transactions.

2.12.Access to certain functions and Digital Services may require the User to create an Account.

2.13.When creating and using an Account, the User shall provide accurate, complete, and up-to-date information to the extent required by the Platform's functionality and shall promptly update such information whenever it changes.

2.14.The User shall not:

  • create an Account on behalf of another person without lawful grounds;
  • provide information that is knowingly false, incomplete, or misleading;
  • impersonate another person, a representative of the Company, or another User;
  • create an Account using another person's contact details, payment details, or identification data without the appropriate authorization;
  • sell, transfer, lease, or otherwise make the Account available to third parties;
  • use the Account for unlawful, fraudulent, or other bad-faith purposes.

2.15.The User shall keep the password, verification codes, and other Account access credentials confidential and shall take reasonable measures to protect the device used from unauthorized access.

2.16.The User shall not disclose one-time verification codes, passwords, or any other data that enables access to the Account or confirmation of a Transaction to any third party.

2.17.Actions performed after successful authentication to the Account using the established means of verification may be deemed to have been performed by the User unless the circumstances of the specific case, the Platform's records, or the User's timely notification indicate that unauthorized access has occurred.

When reviewing such requests, the Company may consider the totality of available technical data, including authentication records, information about the device used, IP addresses, the time the actions were performed, the Account usage history, and any other relevant circumstances.

2.18.The User shall immediately notify the Company upon discovering or having reasonable grounds to suspect:

  • unauthorized access to the Account;
  • loss of the device or access credentials;
  • a Transaction unknown to the User;
  • disclosure of the password, verification code, or other confidential information to a third party;
  • any other threat to the security of the Account.

2.19.After becoming aware of a security threat, the User shall, where such functionality is available, change the login credentials, terminate active sessions, discontinue use of the compromised device, and follow any other reasonable recommendations provided by the Company.

2.20.The Company may temporarily restrict access to the Account or certain Platform functions where there are reasonable grounds to believe that:

  • the Account has been compromised;
  • the Account is being used by an unauthorized person;
  • suspicious, fraudulent, or unlawful activities are being carried out through the Account;
  • the restriction is necessary to prevent damage, verify a disputed Transaction, or protect the User, the Company, other Users, or the Platform;
  • the restriction is required under Applicable Law or by a mandatory request of a competent authority.

2.21.For the purpose of restoring access, verifying a Transaction, confirming ownership of an Account, preventing fraud, or complying with legal requirements, the Company may request additional information and documents from the User to the extent reasonably necessary for the relevant purpose.

2.22.The Company may refuse to restore access or maintain the temporary restriction if the information provided is insufficient to confirm ownership of the Account or eliminate the identified security risk.

2.23.The User may discontinue use of the Account and submit a request for its deletion through the means provided by the Platform's functionality or by contacting customer support.

2.24.Deleting the Application from a device, discontinuing its use, or logging out of the Account shall not automatically result in deletion of the Account.

2.25.Deletion of the Account shall not automatically result in deletion of all information associated with it where continued retention of such information is necessary to fulfill outstanding obligations, process requests and disputes, prevent fraud, protect the Company's legitimate interests, or comply with the requirements of Applicable Law.

2.26.The procedures for processing, storing, deleting, and anonymizing personal data in connection with the creation, use, restriction, and deletion of an Account shall be governed by the Privacy Policy and Applicable Law.

2.27.The Company may retain records confirming the User's acceptance of this Agreement, confirmation of individual Transactions, the version of the Agreement in use, the date and time of the relevant action, technical identifiers, the method of confirmation, and other relevant circumstances for the period necessary to perform this Agreement, comply with legal requirements, process requests, and protect the legitimate interests of the parties.

2.28.Electronic records of the Company's information systems, information provided by Payment Providers, event logs, authentication records, and action confirmation data may be used to establish the circumstances of a Transaction and to review User requests. Such information shall be evaluated together with other available evidence and shall not deprive the User of the right to challenge its accuracy.

2.29.The User shall provide a current email address, telephone number, or any other contact method provided by the Platform and shall promptly update such information. Any adverse consequences resulting from the User's failure to provide current contact information shall be borne by the User to the extent that such consequences were not caused by the Company's actions or omissions.

2.30.Creation of an Account, acceptance of this Agreement, and confirmation of an individual Transaction may be performed electronically by clicking the relevant button, selecting the appropriate checkbox, entering a verification code, using biometric authentication or any other authentication method available on the device, or by performing any other unambiguous action provided for by the Platform interface.

3. Rules for Using the Platform

3.1.The Company grants the User a limited, non-exclusive, non-transferable, and revocable right to use the Platform solely in accordance with this Agreement.

Use of the Platform does not constitute the transfer to the User of any exclusive, proprietary, corporate, or other rights not expressly provided for by this Agreement.

3.2.The User shall use the Platform solely in good faith, by lawful means, and only within the scope of its intended functionality.

3.3.When using the Platform, the User shall:

  • comply with this Agreement;
  • comply with Applicable Law;
  • respect the rights and legitimate interests of the Company, other Users, and third parties;
  • use the Platform solely for its intended purpose;
  • refrain from taking any actions that may compromise the security or stability of the Platform;
  • refrain from exploiting discovered vulnerabilities, errors, or technical malfunctions for unlawful or bad-faith purposes and, where reasonably possible, notify the Company of such circumstances if their exploitation may cause significant harm to the Platform, the Company, or other Users.

3.4.The User shall not:

  • use the Platform for unlawful purposes;
  • use the Platform in a manner that infringes the rights of third parties;
  • obtain or attempt to obtain unauthorized access to the software, servers, databases, Infrastructure, or any other elements of the Platform;
  • interfere with the operation of the Game Mechanics, the Automatic Feeder Selection function, the Additional Platform Functionality, or any other HelpStreetCat algorithms; manipulate the results of their operation; or exploit technical errors, vulnerabilities, delays, malfunctions, or other characteristics of the Platform to obtain unjustified CatPayCoin, Feedings, Bonuses, Internal Digital Objects, or any other advantages;
  • circumvent technical restrictions, security mechanisms, authentication measures, or other security systems;
  • use automated software, bots, scripts, emulators, parsers, automated interaction tools, or any other technologies capable of affecting the normal operation of the Platform;
  • artificially increase activity, create fictitious Transactions, or engage in actions intended to obtain unjustified advantages;
  • interfere with the exchange of data between the Platform and the Infrastructure;
  • decompile, disassemble, reverse engineer, analyze vulnerabilities, modify the software, or otherwise interfere with the operation of the Platform, except where such actions are expressly permitted by mandatory provisions of Applicable Law;
  • use the Platform to distribute malware, viruses, spam, or any other materials that interfere with its operation;
  • use the Platform in any manner that may cause damage to the Company, the Infrastructure, other Users, or the Company's business reputation.

3.5.The User shall not undertake any actions aimed at circumventing the Platform's business model, interfering with the manner in which Digital Services are provided, or obtaining functionality that is made available exclusively under the conditions established by the Company.

3.6.Use of the Platform for the purpose of unauthorized security testing, analysis of proprietary operating algorithms, software analysis, obtaining access to non-public information, or testing technical restrictions shall be permitted only with the Company's prior written consent, except where and only to the extent that such activities are expressly permitted by mandatory provisions of Applicable Law.

3.7.Without the Company's prior written consent, the User shall not use the HelpStreetCat trade name, trademarks, CatPayCoin, logos, branding elements, equipment design, software code, or any other intellectual property owned by the Company, except where expressly permitted by this Agreement, the Platform's functionality, or mandatory provisions of Applicable Law.

If the Platform provides the User with the technical ability to save Observation Materials to the User's device, the User may use such saved materials for personal, non-commercial purposes, including posting them on personal social media accounts, provided that such use:

  • does not create a false impression of partnership, representation, or official affiliation between the User and the Company;
  • does not alter or conceal the Company's trademarks, watermarks, or other identifying marks;
  • is not used to mislead third parties;
  • does not infringe the rights of the Company, other Users, or third parties;
  • is not used for unlawful, offensive, discriminatory, or other bad-faith purposes.

Commercial use of Observation Materials, including their sale, licensing, inclusion in advertising materials, databases, paid media products, or use on behalf of an organization, shall be permitted only with the Company's prior written consent.

The Company may require the User to cease using Observation Materials if such use violates this Agreement, the rights of the Company, the rights of third parties, or Applicable Law.

3.8.The Company shall independently determine the methods used to identify fraudulent, suspicious, or bad-faith activities and may use automated analytical systems, technical logs, risk assessment algorithms, and any other lawful means to ensure the security of the Platform.

The use of automated analytical tools shall not preclude additional review by the Company's personnel where such review is necessary to make an appropriate decision.

3.9.In the event of a breach of this Agreement, the Company may, without prior notice, apply one or more of the following measures:

  • issue a warning;
  • temporarily restrict the use of specific functions;
  • suspend access to the Account;
  • refuse to process a specific Transaction;
  • restrict the use of specific Digital Services;
  • block the Account;
  • terminate the User's access to the Platform in its entirety;
  • take any other reasonable measures necessary to protect the Platform, provided that such measures do not conflict with the mandatory requirements of Applicable Law.

3.10.When selecting an appropriate measure, the Company may take into account the nature of the violation, its consequences, the existence of repeated violations, the amount of actual or potential damage caused, the User's conduct, the level of risk to the Platform, and any other material circumstances.

3.11.The application of one measure shall not deprive the Company of the right to apply additional measures subsequently if further circumstances or the User's subsequent actions make this necessary.

3.12.For the purpose of ensuring the security of the Platform, the Company may refrain from disclosing to the User the criteria used to identify fraudulent activities, the security algorithms employed, the results of internal investigations, or the reasons for applying specific technical restrictions, where disclosure of such information may pose a threat to the security of the Platform, facilitate circumvention of its security mechanisms, or infringe the rights of the Company, other Users, or third parties.

3.13.Any measures applied by the Company under this Section shall be proportionate to the nature of the violation, the identified risk, and the potential consequences for the Company, the Platform, other Users, and third parties.

3.14.Where the nature of the violation permits its remedy without immediate restriction of access, the Company may grant the User a reasonable period to remedy the violation.

The Company shall not be obliged to provide such a period in cases involving fraud, unauthorized access, security threats, violations of Applicable Law, substantial damage, or the need to provide immediate protection to the Platform or third parties.

3.15.Restriction or termination of access to the Account shall not release the Company from its obligations arising in connection with previously confirmed paid Transactions, unless otherwise required by the nature of the violation, the circumstances of fraud, the rules of the Payment Provider, or the mandatory provisions of Applicable Law.

3.16.The User may contact customer support to obtain information regarding the restriction of the Account and to challenge the measure applied.

The Company may refrain from disclosing information where its disclosure could compromise the security of the Platform, the internal mechanisms for fraud prevention, the investigation of the violation, or the rights of third parties.

3.17.The User shall not use Observation Materials to identify individuals who were incidentally captured in the frame, to pursue, harass, humiliate, disclose their personal information, or engage in any other actions that infringe their rights or legitimate interests.

The User shall be solely responsible for any subsequent distribution of Observation Materials saved by the User outside the Platform, in the cases and to the extent permitted by Applicable Law.

4. HelpStreetCat Digital Services

4.1.HelpStreetCat provides Users with access to Digital Services developed and operated by the Company.

The list, content, price, terms of use, technical characteristics, limitations, and availability of individual Digital Services shall be determined by the Company and displayed directly within the Platform.

4.2.Individual Digital Services may be provided:

  • free of charge;
  • for a fee;
  • subject to the creation of an Account;
  • subject to compliance with additional conditions;
  • upon the use of a specified number of CatPayCoin;
  • subject to technical availability.

4.3.By using a Digital Service, the User acquires solely the right to use the corresponding digital function of the Platform to the extent and in the manner provided by its functionality and this Agreement.

No other rights are granted to the User.

4.4.The purchase of a Digital Service does not constitute the acquisition by the User of:

  • equipment;
  • feeders;
  • cameras;
  • servers;
  • software;
  • intellectual property;
  • any property owned by the Company;
  • ownership rights or any other proprietary rights to the Infrastructure;
  • rights to the Company's technologies, algorithms, software code, technical solutions, or business processes;
  • any other rights not expressly provided for by this Agreement.

4.5.A Digital Service associated with the use of a Feeding grants the User the ability to use one Feeding available in the Feeding Balance and, through the Platform, initiate the dispensing of the portion of food provided for by the Platform.

The User may independently select an available feeder or use the Automatic Feeder Selection function, where such functionality is available within the Platform. Automatic Feeder Selection may be accompanied by Game Mechanics and other elements of the Additional Platform Functionality.

Execution of the command shall be performed automatically in accordance with the Platform's operating algorithms, the current technical condition of the Infrastructure, the availability of the relevant feeder, the established security parameters, and other technological characteristics of HelpStreetCat.

4.6.The subject matter of the Digital Service is the provision to the User of the ability to use the corresponding function of the Platform, including the acquisition and use of Internal Digital Objects, their management within the available functionality, and the Initiation of Feeding using the Company's Infrastructure.

The price of the relevant Digital Service shall be determined independently by the Company and may be expressed in monetary funds, CatPayCoin, Feedings, or other Internal Digital Objects, where such arrangement is expressly provided for by the Platform.

The price takes into account the aggregate costs associated with the development and operation of the Platform, the use of equipment, software, server infrastructure, communication channels, data storage and processing, technical maintenance, monitoring, information security, electricity, animal food, logistics, and other resources necessary for providing the relevant Digital Service.

The above description of pricing factors is provided for general informational purposes only and does not mean that the User acquires individual tangible resources, pays for a specific item of equipment, a particular quantity of electricity, or acquires the right to require disclosure of the internal cost structure of the relevant Digital Service.

The description of the factors used in determining the price is provided solely for informational purposes and shall not give rise to any right of the User to require disclosure of commercial information, the Company's internal pricing methodology, or its cost structure beyond the extent required by Applicable Law.

4.7.The Company shall independently determine the methods for the technical implementation of the Digital Services, the architecture of the Platform, the command processing algorithms, the amount of each dispensed portion, the procedure for interaction between the software and the Infrastructure, the technologies used, the technical standards, and other operational parameters of the Platform.

4.8.The Company may develop the Platform and, at its sole discretion:

  • create new Digital Services;
  • modify existing Digital Services;
  • temporarily suspend or discontinue the provision of individual Digital Services;
  • combine or separate individual functions;
  • modify the user interface and the sequence of actions;
  • modify operating algorithms;
  • modify the equipment used;
  • modify the scope, method, or procedure for providing Digital Services;
  • discontinue support for individual functions;
  • implement new technologies and technical solutions.

Such changes shall not deprive the User of a Digital Service that has already been paid for without providing the result specified in the terms of the Transaction, an equivalent opportunity, restoration of the Internal Digital Objects used, or another means of protection required by the mandatory provisions of Applicable Law.

4.9.The Company may modernize the Infrastructure, replace equipment, modify the design and technical specifications of feeders, cameras, and communication devices, software, server architecture, command processing algorithms, communication technologies, and other technical elements of the Platform without obtaining any additional consent from Users.

Such changes shall not in themselves be deemed to constitute a change to the subject matter of this Agreement, provided that they do not deprive the User of the principal functional capability that was expressly provided for by the terms of a previously confirmed and unperformed paid Transaction.

4.10.The Company may independently determine the locations where equipment is installed, the number of devices used, their technical specifications and manufacturers, the types, composition, characteristics, manufacturers, and suppliers of the animal food used, the methods of maintaining the Infrastructure, the schedules for refilling feeders, the amount of each dispensed portion, as well as other technical and organizational parameters governing the operation of the Platform, taking into account Applicable Law, technical capabilities, resource availability, and reasonable security requirements.

4.11.The use of the Digital Services shall not create between the User and the Company any relationship involving the sale or purchase of equipment, equipment lease, agency, mandate, trust management, joint activity, investment, or any other legal relationship, except as expressly provided for by this Agreement.

4.12.The Company may engage affiliates, contractors, subcontractors, technology partners, software developers, equipment and cloud infrastructure providers, telecommunications operators, Payment Providers, service organizations, and other third parties for the development, operation, maintenance, and support of individual elements of the Platform, while remaining a party to this Agreement and retaining responsibility to the extent established by Applicable Law.

4.13.The Company may modify the technology used to provide the Digital Services if such modifications are intended to develop the Platform, improve its security, performance, reliability, quality of service, scalability, or ensure compliance with Applicable Law.

Such modifications shall not in themselves be deemed to constitute a deterioration in the quality of the Digital Service if the User retains the principal functional capability expressly provided for by the terms of the confirmed Transaction or is provided with an equivalent opportunity to use the Platform.

4.14.The result of the Digital Service associated with Feeding shall consist of providing the User with the opportunity, through the Platform, to send a digital command for the use of one Feeding and the automated dispensing of the portion of animal food provided for by the Platform using an available feeder within the Infrastructure.

4.15.The Company does not guarantee the presence of an animal near a feeder at any particular time, the approach of a specific animal to the feeder, the consumption of the dispensed animal food, the duration of the animal's presence within the observation area, or the absence of other animals or persons near the feeder, since such circumstances are beyond the Company's reasonable control.

4.16.The absence of an animal within the feeder area or the animal's refusal to consume the dispensed animal food shall not in itself constitute improper provision of the Digital Service if the digital command was properly accepted and the portion of animal food provided for by the Platform was dispensed.

4.17.Where the Platform provides access to cameras, video streams, video recordings, images, or other means of visual observation, the operation of such functions may depend on lighting conditions, weather conditions, connection quality, the technical condition of the camera, network bandwidth, the location of the equipment, and other technological circumstances.

4.18.Continuous video streaming, a particular image quality, the absence of delays, the preservation of video recordings, or the display of the entire Feeding process shall be guaranteed only where such guarantee is expressly stated in the description of the relevant Paid Digital Service.

4.19.The temporary absence of a video signal or deterioration in image quality shall not in itself constitute non-performance of the Digital Service associated with Feeding if the command to dispense pet food was properly executed and the viewing capability was not expressly defined as an independent material element of the relevant paid Transaction.

4.20.HelpStreetCat is not a veterinary, medical, rescue, or emergency service. Use of the Platform shall not replace contacting the competent public authorities, municipal services, veterinary organizations, or emergency services where an animal requires treatment, rescue, protection, or other immediate intervention.

4.21.Where the Platform provides the ability to create, save, or download to the User's device an image, video recording, or other Observation Material, the result of the relevant function shall consist of providing the technical capability to generate and save such material, provided that a video signal is available and the relevant components of the Platform are functioning properly.

The Company does not guarantee that any particular moment, animal, person, or event will necessarily be captured, that the Observation Material will have any particular duration or quality, or that such material will remain continuously available for repeated saving after the conclusion of the stream.

Once Observation Material has been saved to the User's device, its subsequent storage, backup, deletion, and distribution shall be the sole responsibility of the User.

5. Payments and Acquisition of CatPayCoin

5.1.Certain Digital Services and Internal Digital Objects of the Platform are provided for a fee. Their cost shall be determined by the Company and displayed to the User before confirmation of the relevant Transaction.

5.2.The primary internal unit used to account for the value of HelpStreetCat Digital Services is CatPayCoin. The User may purchase CatPayCoin with monetary funds using the payment methods available on the Platform and may then use them to acquire Feedings, Subscriptions, Internal Digital Objects, and other features made available through the Platform.

5.3.Prior to purchasing CatPayCoin, the User shall be provided with information regarding:

  • the number of CatPayCoin being purchased;
  • the price of the relevant package;
  • the payment currency;
  • the applicable payment method;
  • taxes, fees, or other mandatory charges, where they are required to be displayed separately;
  • other material terms of the Transaction.

5.4.By confirming the purchase of CatPayCoin, the User confirms that they have reviewed the displayed information, understand the nature of the Internal Digital Object being acquired, and consent to making the corresponding payment.

5.5.Payment shall be made using the payment methods available to the User through the Platform, including mobile application stores, banks, payment organizations, and other Payment Providers. The Company may modify the list of supported payment methods, taking into account the technical availability of such methods, the terms of the relevant Payment Providers, and the requirements of Applicable Law.

5.6.If the processing of bank card details or other payment instrument details is carried out directly by the Payment Provider, the Company shall not receive the complete details of the relevant payment instrument, except for limited information that may be provided by the Payment Provider to the Company for the purposes of confirming the Transaction, maintaining records, preventing fraud, handling requests, and complying with the requirements of Applicable Law.

The processing of payment details by the Payment Provider shall be governed by the Payment Provider's own terms, data processing rules, and the legislation applicable to that Payment Provider.

5.7.The Company is not a bank, bank card operator, payment system operator, mobile application store, or independent payment service provider. The processing of monetary payments may be carried out by the relevant Payment Provider in accordance with its own terms and conditions.

5.8.The Company's obligation to credit purchased CatPayCoin shall arise upon receipt of confirmation of successful payment from the relevant Payment Provider. Before crediting CatPayCoin, the Company may carry out reasonable automated or manual verification of the Transaction for the purposes of preventing fraud, abuse, technical errors, and violations of Applicable Law.

5.9.Following confirmation of payment, the corresponding quantity of CatPayCoin shall be credited to the User's CatPayCoin Balance in accordance with the terms displayed at the time the Transaction was completed.

5.10.CatPayCoin may be used exclusively within the Platform. The User may dispose of CatPayCoin only in the ways expressly provided for by the functionality of HelpStreetCat and this Agreement.

5.11.CatPayCoin may be used, among other things, for:

  • acquiring Feedings;
  • acquiring Subscriptions;
  • obtaining other Paid Digital Services;
  • acquiring Internal Digital Objects;
  • participating in loyalty programs, special events, and other opportunities provided by the Platform;
  • Transfer to other Users, if such functionality is provided by the Platform;
  • other purposes expressly provided for by the functionality of HelpStreetCat.

5.12.The amount of CatPayCoin required to acquire a Feeding, Subscription, Internal Digital Object, or other Digital Service shall be determined by the Company and displayed to the User before confirmation of the relevant Transaction.

5.13.The conversion ratio between CatPayCoin and individual Digital Services may be changed. In particular, the amount of CatPayCoin required to obtain one Feeding may be determined by the Company taking into account the current commercial terms, the costs of operating the Platform, the characteristics of the particular offer, the territory of use, and other objective commercial, technical, or economic circumstances.

5.14.Any change to the ratio referred to in Clause 5.12 shall apply exclusively to Transactions confirmed after such change enters into force and shall not reduce the quantity of CatPayCoin, Feedings, or other Internal Digital Objects previously and properly credited to the User, unless otherwise required by mandatory provisions of Applicable Law, the terms of the relevant Bonus, or the need to correct a technical error.

5.15.Upon the User's confirmation of the acquisition of a Feeding, Subscription, or other Digital Service, the corresponding amount of CatPayCoin shall be used, and the acquired Digital Service or Internal Digital Object shall be provided to the User in accordance with the terms of the Transaction.

5.16.CatPayCoin used to acquire a Feeding, Subscription, or other Internal Digital Object shall not be subject to automatic reverse conversion at the User's initiative.

5.17.Feedings, Subscriptions, Bonuses, and other Internal Digital Objects shall not be subject to free reverse conversion into CatPayCoin unless such possibility is expressly provided for by the functionality of the Platform, the terms of the relevant offer, or the mandatory provisions of Applicable Law.

5.18.CatPayCoin are not subject to free exchange for monetary funds, withdrawal from the Platform, payout, cash redemption, or repurchase by the Company. Exceptions shall be permitted only where expressly required by the mandatory provisions of Applicable Law, the rules of the relevant Payment Provider, a court decision, or this Agreement.

5.19.The absence of a right to free reverse conversion shall not limit the User's right to request correction of an erroneous Transaction, restoration of improperly deducted Internal Digital Objects, provision of the paid Digital Service, or any other remedy expressly provided for by the mandatory provisions of Applicable Law.

5.20.The Company may establish minimum and maximum quantities of CatPayCoin available for purchase, limitations on individual Transactions, territorial and technical conditions, and other reasonable restrictions necessary to ensure security, prevent fraud, comply with Applicable Law, and maintain the stable operation of the Platform.

5.21.All Transactions involving CatPayCoin shall be recorded in the Company's information systems. The information displayed to the User may be updated with a technical delay if such delay is caused by data transmission, the operation of the Payment Provider, system synchronization, or other technological circumstances.

5.22.In the event of any discrepancy between the information temporarily displayed in the interface and the accurate data contained in the Company's information systems, the Payment Provider's systems, or the application store, the Company shall be entitled to conduct verification and correct the relevant information based on the confirmed data.

5.23.The Company may temporarily suspend the execution of a Transaction or the crediting of CatPayCoin until verification has been completed if there are reasonable grounds to believe that fraud, a technical error, duplicate charging of funds, unauthorized use of a payment instrument, or other circumstances capable of resulting in the improper crediting of Internal Digital Objects have occurred.

5.24.The Company may grant CatPayCoin as a Bonus, compensation, an element of a loyalty program, a special offer, or on any other basis. Bonus CatPayCoin may be subject to separate validity periods, restrictions, and conditions of use if such conditions have been communicated to the User.

5.25.Unless otherwise expressly specified by the Company, CatPayCoin purchased with monetary funds and CatPayCoin granted as a Bonus may be accounted for separately for the purposes of applying validity periods, restrictions, refunds, and other special conditions.

5.26.The Company may provide the functionality for the Transfer of CatPayCoin between Users. Such Transfer shall not constitute a monetary transfer, shall not involve the exchange of CatPayCoin for monetary funds, and shall be carried out exclusively within the Platform under the conditions established by the Company.

5.27.The Company may establish restrictions on the Transfer of CatPayCoin, including minimum and maximum quantities, frequency, categories of Users, territory, the duration of the Account's existence, successful completion of security verification, and other conditions.

5.28.The User shall not use CatPayCoin to organize unofficial exchanges, sales, intermediary services, settlements outside the Platform, or any other activity not provided for by the functionality of HelpStreetCat. The Transfer of CatPayCoin shall be permitted exclusively between HelpStreetCat Users through the functionality provided by the Platform and shall not constitute a monetary transfer, payment service, electronic funds transfer, or any other independent financial transaction.

5.29.If, after CatPayCoin have been credited, the corresponding monetary payment is canceled, revoked, disputed, refunded, or determined to be unauthorized by the Payment Provider, a bank, an application store, the owner of the payment instrument, or any other authorized person, the Company may:

  • cancel the CatPayCoin credited in connection with the relevant payment;
  • cancel or adjust the Feedings, Subscriptions, Bonuses, and other Internal Digital Objects acquired using such CatPayCoin;
  • temporarily restrict the execution of Transactions and the use of the relevant Internal Digital Objects until the verification has been completed;
  • request information and documents reasonably necessary to verify the legality of the payment;
  • apply other measures provided for by this Agreement and Applicable Law.

The Company may carry out the relevant adjustment automatically without prior notice to the User if any delay could result in the further improper use of Internal Digital Objects.

Such adjustment shall not be deemed an improper deduction if it corresponds to the amount of the canceled, refunded, or unconfirmed payment.

5.30.If, by the time the payment is canceled or refunded, the related CatPayCoin or the Internal Digital Objects acquired using them have been fully or partially used, Transferred, or are no longer available in the relevant Balance, the Company may record the corresponding debt in the internal accounting of the Account and temporarily restrict the acquisition, use, or Transfer of Internal Digital Objects until the resulting discrepancy has been resolved.

The procedure for resolving such discrepancy shall be determined by the Company, taking into account the reason for the payment cancellation, the Digital Services actually used, the rules of the relevant Payment Provider, and the mandatory provisions of Applicable Law.

6. Internal Digital Economy of the Platform

6.1.For the purpose of providing Digital Services, developing the Platform's functionality, and organizing User interaction with the Platform, HelpStreetCat uses an internal digital economy that includes CatPayCoin, Feedings, Subscriptions, Bonuses, and other Internal Digital Objects.

6.2.The internal digital economy forms part of the Platform's functionality and does not constitute a banking, payment, investment, exchange, or any other independent financial system.

6.3.The Company shall independently determine the types of Internal Digital Objects, their functional purpose, the procedures for their acquisition, crediting, use, deduction, storage, Transfer, restriction, restoration, cancellation, and expiration, subject to this Agreement and Applicable Law.

6.4.Internal Digital Objects provide exclusively those capabilities that are expressly provided for by their description, the Platform's functionality, or the applicable special terms. The existence of a particular Internal Digital Object does not grant the User any additional monetary, corporate, investment, proprietary, or other rights not expressly provided for by this Agreement.

6.5.The Company may modify the list of existing Internal Digital Objects, combine them, divide them, replace them with equivalent Internal Digital Objects, or discontinue the use of certain types of Internal Digital Objects, provided that it complies with the mandatory provisions of Applicable Law and respects the rights of Users arising from previously confirmed Transactions.

6.6.A Feeding may be obtained by the User through:

  • purchase using CatPayCoin;
  • crediting as part of a Subscription;
  • receipt as a Bonus;
  • Transfer from another User where such functionality is available;
  • compensatory crediting;
  • any other basis provided for by the Platform.

6.7.After being purchased or credited, a Feeding shall be displayed in the User's Feeding Balance and may be used by the User to Initiate Feeding by independently selecting an available feeder or by using the Automatic Feeder Selection function. The use of a Feeding may be accompanied by Game Mechanics and other elements of the Additional Platform Functionality.

6.8.Unless otherwise expressly provided by the terms of the relevant offer, one Feeding grants the right to one Feeding Initiation.

6.9.A Feeding shall be used by the User by performing the action provided for by the interface. After confirmation of use, the relevant Feeding shall be used, and the number of available Feedings in the Feeding Balance shall be reduced.

6.10.A Feeding shall be deemed used once the Platform has accepted the relevant command and begun its execution, unless otherwise follows from the nature of a technical failure or the mandatory provisions of Applicable Law.

6.11.If Feeding Initiation was not properly performed due to a confirmed technical failure, malfunction or unavailability of the Infrastructure, or other circumstances within the Company's control, the Company shall, at its discretion and taking into account the nature of the violation, technical feasibility, the terms of the relevant Transaction, and the requirements of Applicable Law, apply one or more of the following methods of restoring the User's position:

  • repeated execution of the relevant command;
  • restoration of the used Feeding;
  • provision of an equivalent Feeding;
  • crediting of an equivalent amount of CatPayCoin;
  • provision of an equivalent Digital Service;
  • a full or partial refund of monetary funds, if such refund is required by the mandatory provisions of Applicable Law or selected by the Company taking into account the circumstances of the particular case;
  • another remedy provided for by Applicable Law.

Unless otherwise provided for by the mandatory provisions of Applicable Law, the User shall not be entitled to independently determine the specific method of restoration where the Company is able to properly provide the relevant Digital Service again, restore the Feeding, or provide an equivalent replacement.

6.12.The User shall not be entitled to demand the exchange of unused Feedings for CatPayCoin or monetary funds solely due to a change in the User's intentions, unless such possibility is expressly provided for by the terms of acquisition or the mandatory provisions of Applicable Law.

6.13.The Company may provide Subscriptions that include periodic or one-time crediting of Feedings, CatPayCoin, Bonuses, special functions, and other benefits.

6.14.The specific content of the Subscription, the frequency with which benefits are provided, its validity period, cost, renewal and termination procedures, and other material terms shall be displayed to the User before its acquisition. An automatically renewing Subscription shall provide the User with continuing or regularly renewed value during each paid billing period in accordance with the terms of the relevant offer, the requirements of Applicable Law, and the requirements of the relevant mobile application store.

6.15.The provision of Feedings or other benefits as part of a Subscription shall not mean that the relevant objects may be exchanged for monetary funds or CatPayCoin, unless otherwise expressly provided for by the terms of the Subscription or the mandatory provisions of Applicable Law.

6.16.The Company may introduce new types of Bonuses, digital skills, achievements, items, statuses, levels, access rights, and other Internal Digital Objects.

6.17.The conditions for using a Bonus may provide for:

  • a limited validity period;
  • a limited number of uses;
  • application only to specific functions;
  • the requirement to satisfy specific conditions;
  • the inability to Transfer the Bonus;
  • other reasonable restrictions displayed on the Platform.

6.18.Expiration of a Bonus provided without separate payment shall not create any obligation for the Company to pay its value, replace it, or restore it, unless otherwise provided for by special terms or the mandatory provisions of Applicable Law.

6.19.The Company may provide Users with the ability to Transfer CatPayCoin, Feedings, Subscriptions, Bonuses, or other Internal Digital Objects to other Users.

6.20.The availability of Transfers, the list of transferable objects, restrictions, fees, limits, Account requirements, the procedure for accepting a gift, and other conditions shall be determined by the functionality of the Platform and special rules.

6.21.A Transfer shall become final upon its confirmation and execution by the Platform, unless otherwise provided by the functionality of the relevant Digital Service or unless caused by a technical error, fraud, or unauthorized access to the Account.

6.22.The Company may cancel a Transfer or restore the relevant Internal Digital Objects if a technical error, fraud, unauthorized access, compliance with a mandatory requirement of a governmental authority, or a final and binding court decision is identified.

6.23.The Company may temporarily delay, restrict, reject, or cancel a Transfer where there are indications of fraud, unauthorized access, exploitation of errors, circumvention of restrictions, violation of Applicable Law, or violation of this User Agreement.

6.24.The User shall not be entitled to require the Company to organize a secondary market, repurchase, exchange, or otherwise facilitate the realization of Internal Digital Objects outside the Platform.

6.25.The Company may maintain separate accounting records for Internal Digital Objects depending on the method by which they were obtained, including objects purchased with CatPayCoin, provided as part of a Subscription, granted as a Bonus, Transferred by another User, or credited as compensation.

6.26.Different categories of Internal Digital Objects may be subject to different validity periods, methods of use, Transfer rules, restrictions, and restoration procedures.

6.27.The Company may correct obvious technical errors, duplicate credits, erroneous deductions, and other inaccurate records in its internal accounting on the basis of confirmed data contained in its information systems.

6.28.The correction of a technical error shall not be deemed a unilateral deterioration of the User's rights if such correction is intended to align the CatPayCoin Balance, Feeding Balance, or other accounting records with the Transactions actually performed.

6.29.In the event of a dispute, the Company may take into account the Transaction history, technical logs, Payment Provider data, Infrastructure data, records confirming the User's actions, and other relevant information.

6.30.The Company may adopt separate rules governing the use of CatPayCoin, Feedings, Subscriptions, Bonuses, Transfers, and other Internal Digital Objects. Such rules shall apply together with this User Agreement after they have been communicated to the User in the manner provided by the Platform.

6.31.The User may disable the automatic renewal of a Subscription using the method provided by the Platform or the relevant Payment Provider.

Unless otherwise provided by the terms of the relevant Subscription or the mandatory provisions of Applicable Law, disabling automatic renewal:

  • shall terminate future recurring charges beginning with the next billing period;
  • shall not terminate the current prepaid billing period;
  • shall not result in an automatic refund of the fee paid for the current billing period;
  • shall not result in the automatic exchange or return of Feedings, Bonuses, CatPayCoin, or other Internal Digital Objects already credited.

Deleting the Application, logging out of the Account, or ceasing actual use of the Subscription features shall not, by itself, disable automatic renewal.

6.32.Before submitting a request to delete the Account, the User shall independently use or otherwise dispose of the available CatPayCoin, Feedings, Bonuses, and other Internal Digital Objects in the manner provided by the Platform.

Deletion of the Account at the User's initiative shall not result in the automatic exchange of unused Internal Digital Objects for monetary funds or their transfer to another Account, unless such possibility is expressly provided by the functionality of the Platform, special terms, or the mandatory provisions of Applicable Law.

Before deleting the Account, the Company may notify the User of any unused Paid Digital Services and provide a reasonable period for their use, where technically feasible and required by Applicable Law.

7. Refunds and Withdrawal from Distance Contracts

7.1.The Company shall comply with the rights of Users provided under Applicable Law regarding withdrawal from a distance contract, refunds, remedies for defects in Digital Services, and other consumer protection remedies.

The provisions of this Section shall apply only to the extent permitted by the mandatory provisions of Applicable Law and shall not limit any rights of the User that cannot be excluded or restricted by agreement between the parties.

7.2.HelpStreetCat Digital Services may be provided immediately after confirmation of the relevant Transaction or at another time communicated to the User before such Transaction is confirmed.

7.3.Before confirming a paid Transaction, the User shall be provided with information regarding the Digital Service being acquired, its main characteristics, price, method of provision, applicable restrictions, method of use, and any other information required under Applicable Law.

Immediately before the confirmation of a paid Transaction, the User shall be clearly informed that confirming the relevant action gives rise to an obligation to make payment.

7.4.Where separate consent from the User is required under Applicable Law for the immediate commencement of performance of a Digital Service or for the application of a statutory exception to the right of withdrawal, the Company shall, before confirming the relevant paid Transaction, obtain:

  • the User's explicit consent to commence performance of the Digital Service before the expiration of the statutory withdrawal period;
  • confirmation that the User understands that, once the performance of the Digital Service has commenced or has been fully completed, the right of withdrawal may cease to exist or may not apply in the cases provided by law.

Such confirmation shall be obtained separately from the general acceptance of this User Agreement by means of an unambiguous action provided through the Platform interface and shall be retained in the Company's information systems to the extent necessary to confirm the relevant Transaction.

7.5.The existence, duration, procedure for exercising, and exceptions to the right of withdrawal from a distance contract shall be determined by the mandatory provisions of Applicable Law.

In the cases provided by law, the right of withdrawal may not apply, including, in particular, to services that have been fully performed with the User's prior consent, services whose performance began with the User's consent before the expiration of the withdrawal period, services supplied instantly in an electronic environment, as well as intangible Internal Digital Objects or digital content provided to the User immediately, provided that the Company has complied with all requirements necessary for the application of the relevant exception.

7.6.Acceptance of this User Agreement shall not, in itself, constitute the User's unconditional waiver of the right to withdraw from a distance contract. The non-application or termination of such right shall be determined separately for each specific Transaction and only where the conditions provided by Applicable Law have been satisfied.

7.7.The Company's obligation to provide the purchased Digital Service shall be deemed duly fulfilled after the User has been provided with the functional capability specified in the terms of the relevant Transaction or after the Platform has properly performed the actions constituting the result of the relevant Digital Service.

With respect to a Digital Service related to Feeding, proper performance shall be determined in accordance with Sections 4 and 6 of this User Agreement.

7.8.If a purchased Digital Service has not been provided, has been provided improperly, or its provision has become impossible due to circumstances within the Company's sphere of control, the Company shall, at its discretion, taking into account the nature of the violation, the terms of the relevant Transaction, technical feasibility, and the requirements of Applicable Law, apply one or more of the following remedies to restore the User's position:

  • remedy the identified issue;
  • provide the relevant Digital Service again;
  • restore CatPayCoin, Feedings, or other Internal Digital Objects that were improperly used or deducted;
  • provide an equivalent or comparable Digital Service;
  • credit an equivalent number of CatPayCoin or Feedings;
  • issue a full or partial refund where such refund is required under the mandatory provisions of Applicable Law or is chosen by the Company in light of the circumstances of the particular case;
  • apply any other remedy provided for under the mandatory provisions of Applicable Law.

Unless otherwise required by the mandatory provisions of Applicable Law, the technical possibility of providing the Digital Service again, restoring the used Internal Digital Object, or providing an equivalent replacement shall not create an obligation for the Company to issue a monetary refund.

7.9.When reviewing a User's request, the Company may take into account event logs, technical logs, Infrastructure data, information from Payment Providers, information regarding the use of the Digital Service, records confirming the Transaction, the User's actions, the technical condition of the Platform, and other relevant data.

Such information shall be evaluated together with other available circumstances and shall not deprive the User of the right to provide their own evidence and explanations.

7.10.The following circumstances, in and of themselves, shall not constitute grounds for imposing liability on the Company or for requiring a mandatory refund where they arise outside the Company's reasonable control, including:

  • the absence of or instability in the User's Internet connection;
  • malfunction, improper configuration, or insufficient performance of the User's device;
  • the User's use of incompatible, modified, or outdated software;
  • erroneous actions by the User;
  • the User's failure to follow instructions displayed through the Platform;
  • actions or restrictions of banks, app stores, telecommunications operators, and other third parties;
  • force majeure circumstances;
  • the User's subjective change of intention after the Digital Service has been duly provided.

This paragraph shall not apply to the extent that the relevant circumstance does not exempt the Company from liability under the mandatory provisions of Applicable Law.

7.11.The Company may refuse, in whole or in part, a request for voluntary compensation or a refund if confirmed data establishes fraud, abuse of rights, the use of false information, the artificial creation of grounds for compensation, unauthorized access, a violation of this Agreement, or other bad-faith actions by the User.

Such refusal shall not limit the remedies available to the User under the mandatory provisions of Applicable Law.

7.12.If payment was made through an app store, bank, payment organization, or another Payment Provider, a refund request may be reviewed either by the Company or by the relevant Payment Provider, depending on the payment acceptance procedure, the Payment Provider's terms, and the requirements of Applicable Law.

The User shall comply with the procedure established by the relevant Payment Provider for submitting such a request if the refund is technically processed by that Payment Provider.

7.13.Any refund shall be made using the same payment method that the User used to complete the relevant Transaction, without imposing any additional costs on the User, unless a different procedure is expressly required by the mandatory provisions of Applicable Law or by the technically mandatory rules of the relevant Payment Provider.

The Company shall not issue refunds in cash, by transfer to a third party's account or payment instrument, or by any method other than the original payment method, except where a different procedure is required by Applicable Law or the rules of the relevant Payment Provider.

7.14.Refunds shall be made within the period established by Applicable Law. If the mandatory provisions of Applicable Law provide for a fourteen-day refund period, such period shall be calculated from the moment the Company receives the User's proper notice or from the occurrence of another circumstance provided for by law.

The actual time required for funds to be credited after they have been transferred by the Company to the Payment Provider may depend on the bank, app store, payment system, and other persons involved in processing the payment.

7.15.When issuing a full or partial refund, canceling a payment, or satisfying a request to withdraw from the relevant Transaction, the Company may cancel, reduce, or adjust the amount of CatPayCoin, Feedings, Subscriptions, Bonuses, discounts, special benefits, and other Internal Digital Objects granted directly in connection with the refunded or canceled Transaction, in an amount corresponding to the refunded amount.

If the relevant Internal Digital Objects have already been used, Transferred, or otherwise disposed of by the User, the Company may take such use into account when determining the appropriate method of restoring the parties to their previous position, make appropriate adjustments to its internal accounting, and apply the measures provided for in Sections 5.29 and 5.30 of this Agreement, to the extent permitted by Applicable Law.

7.16.The User may submit a request regarding withdrawal from a distance contract, a refund, an erroneous Transaction, or the improper provision of a Digital Service through the functionality provided by the Platform or using the Company's support contact details.

The request shall enable the Company to identify the User and the relevant Transaction and should, where possible, include the date of the Transaction, its identifier, a description of the issue encountered, and any relevant supporting materials. The Company shall not require information or documents that are clearly unrelated to the review of the request.

7.17.Requests shall be reviewed individually, taking into account the circumstances of the particular case, the terms of the confirmed Transaction, information from the information systems, the principles of reasonableness, good faith, and proportionality, as well as the requirements of Applicable Law.

8. Additional Platform Functionality and Game Mechanics

8.1.The Company may develop and provide Users with Additional Platform Functionality, including Game Mechanics, Automatic Feeder Selection, interactive user scenarios, achievements, digital objects, special features, entertainment elements, and other auxiliary HelpStreetCat functions.

8.2.Additional Platform Functionality is intended to enhance the convenience of using HelpStreetCat, diversify the user experience, expand the ways Users interact with Digital Services, and increase interest in the remote feeding of animals.

8.3.Additional Platform Functionality constitutes an auxiliary part of the HelpStreetCat Digital Services and does not alter the primary purpose of the Platform, which is to provide Users with the ability to remotely feed animals through the Company's Infrastructure.

8.4.Game Mechanics may include the performance by the User of certain actions, the use of interactive user scenarios, the automatic or variable determination of certain parameters, the display of animations and visual effects, the granting of achievements, Bonuses, personalized offers, user rankings, statuses, levels, seasonal features, Internal Digital Objects, access to certain Platform functions, and other entertainment or interactive elements.

8.5.The specific rules, content, procedure for use, availability conditions, and technical implementation of a particular Game Mechanic shall be determined by the Platform functionality, the information displayed to the User prior to its use, and, where applicable, the special rules governing the relevant Game Mechanic.

8.6.If a particular Game Mechanic involves the use of CatPayCoin, Feedings, a Subscription, or another Internal Digital Object, information regarding such use and its material conditions shall be displayed to the User before the relevant action is confirmed.

If the outcome of a paid Game Mechanic includes the provision of randomly or variably determined Internal Digital Objects, and disclosure of the probability of obtaining them is required under Applicable Law or the rules of the relevant mobile application store, such probability or the method for determining it shall be disclosed to the User before the paid action is confirmed.

8.7.Game Mechanics are not intended for organizing gambling, lotteries, betting, investment activities, or any other means of enabling the User to obtain monetary payments or independent economic benefits outside HelpStreetCat.

8.8.The presence within a Game Mechanic of an automatically determined, random, variable, or otherwise previously unknown outcome shall not, in itself, entitle the User to receive money, property, income, or any other economic benefit outside the Platform.

8.9.Bonuses, CatPayCoin, Feedings, Subscriptions, achievements, digital objects, special features, and other Internal Digital Objects provided within the framework of Game Mechanics shall be used exclusively within the HelpStreetCat functionality in accordance with this Agreement and the special terms governing the relevant function.

8.10.Internal Digital Objects provided within the framework of a Game Mechanic without separate payment have no independent monetary value and may not be exchanged for money, withdrawn from the Platform, sold, redeemed for cash, or repurchased by the Company, unless otherwise expressly required by the mandatory provisions of Applicable Law.

8.11.The User shall not be entitled to demand the provision of a specific Bonus, Internal Digital Object, special feature, or any other outcome of a Game Mechanic unless the provision of such an outcome is expressly guaranteed by the terms of the relevant function.

8.12.One of the functions of the Additional Platform Functionality is Automatic Feeder Selection.

8.13.The primary purpose of the Automatic Feeder Selection function is to simplify the User's selection of an available feeder when using a Feeding.

8.14.The Automatic Feeder Selection function is used by consuming one Feeding available to the User, unless a different procedure is expressly provided for by the terms of the relevant Digital Service.

8.15.After the User confirms the relevant action, the Platform shall automatically determine one of the available feeders and transmit a Feeding Initiation command through the selected equipment.

8.16.Automatic Feeder Selection shall be performed by the Platform's software algorithms, taking into account the technical availability of feeders, the condition of the Infrastructure, network connectivity, the current operational status of the equipment, established limitations, the territorial characteristics of feeder placement, and other technical parameters of HelpStreetCat.

8.17.Use of the Automatic Feeder Selection function shall result in the use of one Feeding for Feeding Initiation regardless of the animation, visual design, interactive elements, or other accompanying Game Mechanics displayed to the User, unless a different outcome is expressly provided for by the terms of the relevant function.

8.18.When using Automatic Feeder Selection, the User receives the primary Digital Service provided, namely the ability to perform Feeding Initiation at an automatically selected feeder. The game, visual, and entertainment elements constitute an additional part of the user experience and do not replace the primary Digital Service.

8.19.Use of the Automatic Feeder Selection function may be accompanied by the provision to the User of additional Feedings, CatPayCoin, Subscriptions, Bonuses, achievements, digital objects, temporary access to certain functions, or other Internal Digital Objects.

8.20.The possibility of receiving an additional Internal Digital Object through the use of Automatic Feeder Selection does not alter the primary purpose of the relevant function and does not mean that the User acquires the right to participate in a prize drawing for money, property, or any other independent item of economic value.

8.21.The User shall not be entitled to require the selection of a specific feeder when using the Automatic Feeder Selection function, except where the Platform functionality expressly provides the ability to determine certain selection parameters.

8.22.The Company may modify the Automatic Feeder Selection algorithms, the list of available feeders and the criteria for their availability, the user interface, the sequence of actions, the visual design, animations, the composition of the Game Mechanics, the list of Bonuses and Internal Digital Objects, and other parameters of the Additional Platform Functionality.

8.23.The Company may create, modify, combine, divide, temporarily suspend, or discontinue individual Game Mechanics and other elements of the Additional Platform Functionality unless otherwise required by the mandatory provisions of Applicable Law or by the terms of a paid Transaction previously confirmed by the User.

8.24.Changes to the Additional Platform Functionality shall not affect Internal Digital Objects previously and properly acquired by the User for consideration to the extent that the preservation of such objects or the provision of an equivalent opportunity is required by the terms of the confirmed Transaction or by the mandatory provisions of Applicable Law.

8.25.The Company may adopt separate special rules governing an individual Game Mechanic, temporary event, themed season, promotion, loyalty program, ranking, task, achievement, or other user scenario.

The special rules governing the relevant function may specify, in particular:

  • the name and description of the Game Mechanic;
  • its duration;
  • the territory and categories of Users for whom it is available;
  • the conditions for commencing and terminating participation;
  • the actions the User must perform;
  • the number of CatPayCoin, Feedings, or other Internal Digital Objects to be used;
  • the procedure for determining the outcome;
  • the list and conditions for granting Bonuses, skills, achievements, statuses, levels, and other Internal Digital Objects;
  • the validity periods and limitations applicable to such objects;
  • technical, age-based, territorial, and other restrictions;
  • the grounds for refusing to provide the outcome, reversing an erroneous credit, or excluding the User from the relevant Game Mechanic;
  • the procedure for handling User requests;
  • other material terms of the relevant function.

The special rules shall be made available to the User before the User performs any action that results in the use of a Paid Digital Service, CatPayCoin, a Feeding, or another Internal Digital Object acquired for consideration.

8.26.The User is prohibited from interfering with the operation of Game Mechanics or the Automatic Feeder Selection function, manipulating the operation of algorithms, using errors, vulnerabilities, software tools, automated systems, multiple Accounts, or any other unfair methods to obtain unjustified Bonuses, CatPayCoin, Feedings, Subscriptions, Internal Digital Objects, or other advantages.

8.27.If the Company detects a technical error, manipulation, abuse, or any other unfair use of the Additional Platform Functionality, it may conduct a review, temporarily restrict the relevant function, correct erroneous records, reverse any unjustified credit, and apply other measures provided for by this Agreement and Applicable Law.

8.28.The display within the user interface of animations, interactive elements, visual effects, virtual wheels, progress bars, cards, characters, additional screens, action sequences, or other design elements is informational, interactive, or entertainment in nature and does not, in itself, alter the legal nature of the Digital Service provided.

8.29.The Additional Platform Functionality and the Game Mechanics do not create investment, banking, insurance, exchange, payment, or any other financial legal relationship between the User and the Company, except for those directly arising from the payment for and provision of the relevant Digital Services.

8.30.The Company may conduct temporary digital events, promotions, themed seasons, user events, special programs, and time-limited Game Mechanics forming part of the Additional Platform Functionality.

The duration of such events, the scope of available functions, the conditions of participation, the procedure for completing actions, the list of Bonuses and Internal Digital Objects provided, applicable restrictions, and other material terms of the relevant event shall be determined by the special rules and made available to the User before the User performs any action that results in the use of a Paid Digital Service or an Internal Digital Object.

8.31.The special rules governing a particular Game Mechanic shall apply together with this Agreement.

In the event of any inconsistency between this Section and the special rules governing the relevant Game Mechanic, the special rules shall prevail solely with respect to the regulation of that particular Game Mechanic, provided that they:

  • were made available to the User before the relevant action was performed;
  • do not conflict with the mandatory provisions of Applicable Law;
  • do not retroactively alter the price or other material terms of a paid Transaction that has already been confirmed;
  • do not reduce Internal Digital Objects previously and properly acquired by the User for consideration, except where necessary to correct a technical error, address fraud, reverse a payment, or comply with a mandatory requirement of a competent authority.

8.32.If the outcome of a Game Mechanic is determined automatically, variably, or through an element of chance, the records of the Company's information systems shall constitute the authoritative source of information regarding that outcome.

The visual animation, virtual wheel, progress bar, card, character, graphical effect, or any other display of the outcome in the user interface may be entertainment in nature and shall not constitute independent evidence that the User has received any outcome other than the outcome recorded in the Company's information systems.

If a technical error, a discrepancy between the animation and the outcome actually recorded, a duplicate credit, or any other malfunction is identified, the Company may correct the relevant account and provide the User with the outcome reflected in the confirmed records of its information systems or, at the Company's discretion, an equivalent remedy.

9. Intellectual Property

9.1.All rights to the Platform, the Application, the Website, the Infrastructure, software, databases, the user interface, design, source code, algorithms, technologies, technical solutions, documentation, photographs, video materials, live broadcasts, graphic materials, text, audio materials, trademarks, logos, trade names, commercial designations, industrial designs, inventions, utility models, patents, patent applications, know-how, trade secrets, copyrightable works, as well as all other intellectual property objects and means of individualization belong to the Company, its Affiliates, licensors, or are otherwise used by the Company on another lawful basis.

9.2.The HelpStreetCat and CatPayCoin trademarks, the Company's logos, corporate identity, elements of the Platform's visual design, equipment design, Infrastructure design, and other means of individualization are protected by intellectual property laws and may not be used without the Company's prior written consent unless otherwise expressly permitted by mandatory provisions of Applicable Law.

9.3.The Company may register, maintain, renew, assign, license, and otherwise dispose of its Intellectual Property Objects in any country of the world.

9.4.Use of the Platform does not constitute the transfer to the User of any exclusive, proprietary, licensing, or other rights to the Company's Intellectual Property Objects, except for the limited right to use the Platform in accordance with this Agreement.

9.5.The User may not, without the Company's prior written consent:

  • copy the Platform's software in whole or in part;
  • reproduce, distribute, publish, translate, adapt, modify, or otherwise use the Company Content, except for the personal non-commercial use of Observation Materials expressly permitted under Section 3.7 of this Agreement;
  • alter, adapt, modify, or create derivative works based on the Company's Intellectual Property Objects;
  • decompile, disassemble, reverse engineer, or examine the internal structure of the software, except where such actions are expressly permitted by mandatory provisions of Applicable Law;
  • remove or alter copyright notices, trademark notices, or other proprietary notices of the Company;
  • use trademarks, trade names, logos, or other means of individualization in a manner capable of creating the impression of an association with the Company without its consent;
  • use automated means to extract the Company Content, train artificial intelligence models, create derivative databases, or develop other machine learning systems without the Company's prior written consent.

9.6.Any rights to the Company's Intellectual Property Objects that are not expressly granted to the User under this Agreement are reserved by the Company.

9.7.If the Platform functionality allows the posting of User Content, the User warrants that they possess all necessary rights to such User Content and shall bear sole responsibility for its lawfulness.

9.8.By posting User Content through the Platform, the User grants the Company a non-exclusive, royalty-free, worldwide license, valid for the entire term of protection of the relevant rights, to use such User Content solely to the extent necessary for the operation of the Platform, performance of this Agreement, provision of Digital Services, maintenance of the Platform, and its promotion where such use follows from the nature of the User Content posted by the User.

Such license shall terminate with respect to the User Content after it is deleted by the User from the Platform, except where its continued storage or use is necessary for the performance of this Agreement, compliance with Applicable Law, protection of the Company's rights, or where such User Content has already been used as part of lawfully published Company materials.

9.9.The User retains all rights to their User Content except to the extent such rights have been granted to the Company under this Agreement.

9.10.The Company may restrict access to User Content, remove it in whole or in part, or take other reasonable measures if there are grounds to believe that such User Content:

  • violates Applicable Law;
  • infringes the rights of third parties;
  • violates this Agreement;
  • creates a threat to the security of the Platform;
  • is capable of causing damage to the Company or other persons.

9.11.If the User submits to the Company any proposals, ideas, comments, recommendations, or other information relating to the improvement of the Platform or its functionality, the Company may use such materials without limitation as to time, territory, or methods of use and without payment of any remuneration, unless otherwise agreed by the Parties in writing.

9.12.The discovery of an infringement of the Company's rights to its Intellectual Property Objects shall not limit the Company's right to use any remedies provided by Applicable Law, including the right to seek cessation of the infringement, removal of unlawfully published materials, recovery of damages, compensation, reimbursement of legal costs, and the application of any other civil, administrative, or other measures of liability provided by Applicable Law.

10. Liability of the Parties and Limitation of Liability

10.1.The Company takes reasonable organizational and technical measures to ensure the stable operation of the Platform; however, it does not guarantee its uninterrupted, error-free, or continuous operation.

10.2.The User understands and agrees that the Digital Services are provided through the Internet, software, equipment, telecommunications operators, cloud infrastructure providers, payment service providers, and other third parties whose activities are beyond the Company's reasonable control.

10.3.The Company shall not be liable for any total or partial failure to perform its obligations if such failure results from:

  • interruptions in the operation of the Internet;
  • actions or omissions of telecommunications operators;
  • actions of banks, payment systems, application stores, or other payment service providers;
  • failures of cloud infrastructure;
  • interruptions in the power supply;
  • actions of governmental authorities;
  • cyberattacks, provided that the Company has taken reasonable security measures;
  • force majeure circumstances;
  • other circumstances beyond the Company's reasonable control.

10.4.The Company does not guarantee that the Platform will meet the User's individual expectations or be available for use without any restrictions in every country, on every device, or under all operating conditions.

10.5.To the extent permitted by the mandatory provisions of Applicable Law, the Company shall not be liable for:

  • actions of other Users;
  • the content and operation of third-party websites and services that are not controlled by the Company;
  • third-party software independently installed or used by the User;
  • the actions of banks, application stores, telecommunications operators, and other independent third parties within the scope of their own activities and responsibilities;
  • decisions made by the User based on informational, reference, or user-generated materials, unless such materials were expressly provided by the Company as a mandatory guarantee.

The Company's engagement of contractors, subcontractors, and technology partners shall not release the Company from liability to the User to the extent that such liability is expressly imposed upon the Company by the mandatory provisions of Applicable Law.

10.6.The Company shall not be liable for the inability to use the Platform resulting from:

  • the User's use of incompatible equipment;
  • the User's use of outdated versions of software;
  • the User's violation of this Agreement;
  • restriction of the Account in the cases provided for by this Agreement;
  • the actions or omissions of the User.

10.7.Unless otherwise required by the mandatory provisions of Applicable Law, the Company shall not be liable for indirect damages, lost profits, loss of goodwill, loss of data, loss of anticipated revenue, or any other indirect pecuniary losses incurred by the User.

10.8.Unless otherwise required by the mandatory provisions of Applicable Law, the Company's aggregate liability for all claims made by the User in connection with a specific paid Transaction shall be limited to the amount actually paid by the User for the relevant Digital Service under that Transaction.

10.9.Nothing in this Agreement shall exclude or limit the Company's liability where such exclusion or limitation is expressly prohibited by the mandatory provisions of Applicable Law.

10.10.The User shall bear sole responsibility for:

  • the accuracy of the information provided;
  • the lawful use of the Platform;
  • safeguarding the data of their Account;
  • actions performed using their Account, to the extent provided by this Agreement and Applicable Law;
  • compliance with the laws of the country in which they are present.

10.11.The User shall compensate the Company for direct, documented losses arising from the User's culpable violation of this Agreement, Applicable Law, or the rights of third parties, including reasonable expenses incurred for:

  • investigating fraud, unauthorized access, and other violations;
  • restoring the operation and security of the Platform;
  • eliminating the consequences of the use of errors, vulnerabilities, bots, and other prohibited means;
  • protecting the Company's Intellectual Property Objects;
  • satisfying justified claims of third parties;
  • the Company's judicial and other legal defense.

Such compensation shall be made only in the cases and to the extent permitted by Applicable Law, provided that there is a causal link between the User's violation and the losses incurred by the Company.

10.12.If any limitation of liability set forth in this Agreement is determined to be inapplicable to a particular claim of the User, the remaining limitations of liability shall continue to apply to the maximum extent permitted by Applicable Law.

11. Suspension and Termination of Access to the Platform

11.1.The Company may fully or partially restrict, suspend, or terminate the User's access to the Platform or to certain of its Digital Services in the cases provided for by this Agreement, Applicable Law, or where this is objectively necessary to ensure the security of the Platform, the Company, the Users, or third parties.

11.2.The grounds for applying the measures specified in Section 11.1 of this Agreement may include, in particular:

  • violation of this Agreement;
  • provision of inaccurate information;
  • use of the Platform for unlawful purposes;
  • fraudulent or suspicious activities;
  • infringement of the rights of the Company or third parties;
  • attempts to circumvent technical restrictions;
  • interference with the operation of the Platform;
  • violation of information security requirements;
  • mandatory requirements imposed by governmental authorities;
  • other circumstances that objectively create a threat to the security of the Platform or the legitimate interests of the Company.

11.3.The Company shall independently determine the nature of the measure to be applied, taking into account the circumstances of the particular case, the nature of the violation, the degree of risk, any repeated violations, the potential consequences, and other relevant circumstances, including automated means of detecting violations.

11.4.Depending on the circumstances, the Company may:

  • issue a warning;
  • temporarily restrict access to certain functions;
  • suspend the performance of specific Transactions;
  • temporarily block the Account;
  • restrict the use of CatPayCoin;
  • temporarily suspend the accrual, use, or Transfer of CatPayCoin;
  • cancel or adjust Internal Digital Objects credited as a result of an error, without proper grounds, or as a result of a canceled payment;
  • temporarily restrict the use of Feedings, Subscriptions, Bonuses, and other Internal Digital Objects until the relevant Transaction has been reviewed;
  • terminate access to certain Digital Services;
  • permanently terminate the use of the Account.

11.5.If this does not conflict with the requirements of Applicable Law and does not create a threat to the security of the Platform, the Company may notify the User of the application of the relevant measures.

The absence of prior notice shall not in itself indicate that the Company's actions were unlawful.

11.6.The Company may decline to disclose to the User:

  • the algorithms used to detect violations;
  • risk assessment criteria;
  • the results of internal investigations;
  • security methods;
  • technical protection measures;
  • any other information the disclosure of which could facilitate the circumvention of the Platform's security mechanisms.

11.7.The User may submit a request to the Company for reconsideration of the decision if the User believes that the access restriction was imposed in error.

The Company shall review such request within a reasonable period, taking into account the circumstances of the particular case.

11.8.If the grounds for restricting access cease to exist or if the decision to restrict access was made in error, the Company shall restore the User's access without undue delay to the extent appropriate under the circumstances of the particular case, unless otherwise required by the mandatory provisions of Applicable Law or by the security requirements of the Platform.

The decision to restore access shall be made by the Company taking into account the nature of the violation, the User's conduct, and the security requirements of the Platform.

11.9.Termination of access to the Platform shall not in itself release the User from performing any monetary obligations that arose before such termination, or from any other obligations that, by their nature, continue to apply after the termination of this Agreement.

12. Changes to the Platform and this Agreement

12.1.The Company may develop the Platform and modify its functionality, architecture, user interface, design, technical solutions, the range of Digital Services, the methods of providing such services, the technologies used, operational algorithms, as well as other elements of the Platform.

12.2.The Company may amend this Agreement if such amendments are necessitated by:

  • the development of the Platform;
  • the introduction of new Digital Services;
  • changes in legislation;
  • changes in applicable requirements imposed by governmental authorities;
  • technological developments;
  • changes to the Platform's business model;
  • the need to enhance information security;
  • the correction of errors, inaccuracies, or inconsistencies;
  • improvements to the terms of use of the Platform;
  • other reasonable circumstances related to the Company's activities.

12.3.A new version of this Agreement shall become effective upon its publication on the Platform or on such other date as may be specified in the relevant version, unless a different procedure is required by the mandatory provisions of Applicable Law.

12.4.The Company may notify Users of amendments to this Agreement by means of a notice on the Platform, a notification in the Application, a message sent to the email address provided by the User, or by any other available electronic means.

The Company shall determine the method and timing of such notification at its own discretion, taking into account the nature of the amendments, the technical capabilities of the Platform, and the mandatory requirements of Applicable Law.

If the amendments materially affect the terms of Paid Digital Services, the rules governing the use of Internal Digital Objects acquired for monetary consideration, the automatic renewal of a Subscription, or the grounds for restricting access, the User shall be provided with a reasonable opportunity to review such amendments before they become effective, unless a different procedure is required by Applicable Law.

12.5.Continued use of the Platform after a new version of this Agreement becomes effective shall constitute acceptance of the relevant amendments to the extent that such method of acceptance is permitted under Applicable Law.

If Applicable Law or the nature of a particular amendment requires the User's separate explicit consent, the Company may restrict access to the relevant new or modified function until such consent has been obtained through the confirmation method provided by the Platform.

The User's refusal to accept the new version of this Agreement shall not deprive the Company of the right to discontinue, in the future, the provision of functions whose use is impossible without the application of the updated terms, while preserving the User's rights arising from previously confirmed paid Transactions.

This Section shall apply only where the relevant method of accepting amendments is permitted by the mandatory provisions of Applicable Law.

12.6.If the User does not agree with the new version of this Agreement, the User must discontinue using the Platform and may delete the User's Account in accordance with the functionality provided by the Platform.

12.7.Changes to the pricing of Digital Services, the rules governing the use of CatPayCoin, or other commercial terms shall apply exclusively to Transactions completed after such changes become effective, unless a different approach is permitted under Applicable Law.

12.8.Nothing in this Section grants the Company the right to unilaterally modify the terms of Transactions that have already been fully performed, unless otherwise required by the mandatory provisions of Applicable Law.

13. Governing Law and Dispute Resolution

13.1.This Agreement shall be governed by and construed in accordance with the laws of the Republic of Türkiye, unless otherwise required by the mandatory provisions of private international law or other mandatory provisions of Applicable Law.

13.2.Before referring a dispute to a court or other competent authority, the Parties shall seek to resolve any disagreements through negotiations and the exchange of written communications.

13.3.The User may submit an inquiry or claim to the Company using the communication methods specified on the Platform.

The Company shall review such inquiries or claims within a reasonable period, taking into account their nature, the scope of any necessary verification, and the requirements of Applicable Law.

13.4.If a dispute cannot be resolved through negotiations, it shall be submitted to the competent court or other authorized authority in accordance with the procedures established by Applicable Law.

13.5.If the mandatory provisions of Applicable Law establish exclusive jurisdiction or a special venue for a particular dispute, such dispute shall be resolved in accordance with those mandatory provisions.

13.6.If any provisions of this Agreement grant the User additional means of protecting the User's rights as provided under the mandatory provisions of consumer protection legislation, such rights shall remain fully preserved.

13.7.Nothing in this Agreement shall deprive the User of the right to apply to governmental authorities, courts, or other competent authorities in the cases and in the manner provided for by the mandatory provisions of Applicable Law.

14. Final Provisions

14.1.This Agreement constitutes the entire agreement between the Company and the User regarding the use of the Platform and supersedes all prior understandings, representations, and agreements relating to the same subject matter, unless otherwise expressly provided by this Agreement.

14.2.If any provision of this Agreement is held to be wholly or partially invalid, unlawful, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions of this Agreement, which shall continue in full force and effect to the maximum extent permitted by Applicable Law.

14.3.The Company's failure to exercise, or any delay in exercising, any right granted under this Agreement shall not constitute a waiver of such right in the future.

14.4.The Company may assign or transfer, in whole or in part, its rights and obligations under this Agreement to its Affiliates, successors, or in connection with a business reorganization, sale of assets, sale of the Platform, or any other corporate restructuring, provided that such transfer does not conflict with the mandatory requirements of Applicable Law.

14.5.The User may not assign any rights or delegate any obligations under this Agreement without the Company's prior written consent, unless otherwise required by the mandatory provisions of Applicable Law.

14.6.Section headings are included solely for convenience and shall not affect the interpretation of this Agreement.

14.7.This Agreement may be published in multiple languages. In the event of any inconsistency between language versions, the version designated by the Company as the governing version for the relevant jurisdiction or language of Platform use shall prevail.

14.8.This Agreement shall enter into force on the date of its publication on the Platform or on such other date as specified by the Company in the relevant version.

14.9.The Company may adopt, amend, revoke, and publish additional documents governing specific aspects of the operation of the Platform, including special terms governing Digital Services, rules relating to CatPayCoin, Game Mechanics, temporary events, themed seasons, bonus programs, loyalty programs, promotions, Internal Digital Objects, Transfers, and individual Platform functions.

Such additional documents shall become applicable to the User after they have been made available to the User by the means provided by the Platform and from the date specified in the relevant document.

If the relevant function involves payment or the use of CatPayCoin, Feedings, or other Internal Digital Objects acquired for consideration, the special terms applicable to that function shall be made available to the User before confirmation of the relevant action.

An additional document shall not retroactively amend the terms of any previously confirmed paid Transaction, except where necessary to correct a technical error, address fraud, reverse a payment, or comply with a mandatory requirement of Applicable Law or a competent authority.

14.10.In all matters not expressly governed by this Agreement, the Parties shall be governed by the mandatory provisions of Applicable Law.

14.11.Where specific Digital Services, Game Mechanics, bonus programs, the use of CatPayCoin, or other special Platform functions are governed by separate special terms, such special terms shall apply together with this Agreement.

In the event of any inconsistency between this Agreement and the special terms applicable to a particular Digital Service, the special terms shall prevail solely with respect to the regulation of that Digital Service, unless otherwise required by the mandatory provisions of Applicable Law.

14.12.The provisions of this Agreement which, by their nature, are intended to survive the termination of the use of the Platform, including provisions relating to intellectual property, liability, dispute resolution, data processing, refunds, limitation of liability, and other similar provisions, shall remain in effect after the termination of this Agreement to the extent applicable.

14.13.The Company may carry out a complete or partial reorganization of the Platform, modify its architecture, service structure, business model, methods of providing Digital Services, internal digital economy, technologies used, functional scope, commercial terms of individual services, and may merge, divide, rename, or discontinue individual Digital Services, subject to compliance with Applicable Law.

14.14.If, as a result of changes in legislation, judicial practice, or mandatory requirements of governmental authorities, any provision of this Agreement ceases to comply with Applicable Law, such provision shall be interpreted and applied to the maximum extent permitted by the applicable legislation without affecting the continued validity of the remaining provisions of this Agreement.
